These Terms of Use ("Terms") govern your access to and use of the websites, applications, APIs, and other products and services provided by Asian Intelligence ("Asian Intelligence," "we," "us," or "our"), collectively, the "Services." By accessing or using the Services, you agree to these Terms.
1. Eligibility and authority
You must be at least 18 years old, or the minimum legal age required to enter into a binding contract where you live, to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts and access
You must provide accurate information, protect your account credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account. Early-access invitations and credentials may not be transferred without our permission.
3. Permitted use
You may use the Services only in compliance with these Terms and applicable law. You may not:
- use the Services to violate the rights of others or any law or regulation;
- upload malicious code or interfere with the integrity, security, or operation of the Services;
- attempt to gain unauthorized access to accounts, systems, or networks;
- misrepresent generated content as human-created where disclosure is required by law;
- use automated means to scrape or extract data except as expressly allowed by us; or
- resell, sublicense, reverse engineer, or circumvent restrictions on the Services except where applicable law does not allow such restrictions.
4. Your content
You retain ownership of content you submit to the Services ("Input"). As between you and Asian Intelligence, and to the extent permitted by law, you own model-generated responses produced specifically for you ("Output"). You grant us the limited rights necessary to host, process, transmit, and display Input and Output to operate, secure, and improve the Services and comply with law.
You are responsible for ensuring that you have the rights needed to submit Input and for your use of Output. Output may be inaccurate, incomplete, or similar to content generated for others. You must independently evaluate Output before relying on or sharing it, especially for legal, medical, financial, employment, or other high-impact decisions.
5. Third-party models and services
The Services may provide access to models, content, or services operated by third parties. Your use of those features may be subject to additional terms. We do not control third-party services and are not responsible for their availability, content, or practices.
6. Our intellectual property
The Services, including their software, design, branding, and documentation, are owned by Asian Intelligence or its licensors and are protected by intellectual-property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.
7. Feedback
If you provide ideas, suggestions, or other feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation to you.
8. Fees and taxes
If paid features are offered, applicable fees, billing terms, and usage limits will be disclosed before purchase or in a separate order. You are responsible for applicable taxes, except taxes based on our net income.
9. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms, create risk or possible legal exposure, fail to pay amounts due, or if we discontinue the Services. Provisions that by their nature should survive termination will remain in effect.
10. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available." Asian Intelligence disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services or Output will be accurate, uninterrupted, secure, or error-free.
11. Limitation of liability
To the fullest extent permitted by law, Asian Intelligence and its affiliates, officers, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from or related to the Services or these Terms.
To the fullest extent permitted by law, our total liability for all claims arising from or related to the Services or these Terms will not exceed the greater of the amount you paid us for the Services during the 12 months before the event giving rise to the claim or US$100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Asian Intelligence and its affiliates, officers, employees, and agents from claims, losses, liabilities, and expenses arising from your Input, your use of the Services, or your violation of these Terms or another person's rights.
13. Changes to the Services or Terms
We may modify the Services and these Terms from time to time. We will post updated Terms here and revise the effective date. If a change is material, we will provide notice as required by law. Your continued use after the updated Terms take effect constitutes acceptance.
14. General terms
These Terms and any additional terms that apply to the Services form the entire agreement between you and Asian Intelligence regarding the Services. If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, merger, acquisition, or transfer of assets.
